1. Introduction
These Terms and Conditions ("Terms") govern the relationship between you, the customer ("you" or "the client"), and Global Encounter ("we", "us", or "the Company"), a tour operator registered in the United Kingdom, in relation to all bookings made with us, whether directly or via our website, email, telephone, or approved agents. By booking a tour or service with us, you agree to be bound by these Terms.
2. Booking and Payment
- All bookings are subject to availability and must be confirmed in writing by us.
- A non-refundable deposit of 15% per person is required at the time of booking unless otherwise stated.
- The balance of the tour price must be paid no later than Six weeks before the departure date. If payment is not received by the due date, we reserve the right to treat your booking as cancelled by you and retain your deposit.
- We accept payment by bank transfer, credit/debit card, or other methods as notified to you.
3. Price and Surcharges
- All prices are quoted in pounds sterling (£) and include VAT where applicable.
- We reserve the right to alter the prices of any tours shown in our brochures or on our website at any time before your booking is confirmed.
- After your booking is confirmed, we may only increase the price in the event of significant cost increases beyond our control (such as government action, currency fluctuations, or increased fuel costs). Any surcharges will be notified in writing and will not exceed 10% of the tour price.
4. Changes and Cancellations by You
- If you wish to amend or cancel your booking, you must notify us in writing as soon as possible.
- Amendments may incur an administration fee and any additional costs imposed by suppliers.
- Cancellation charges will apply as follows:
- More than Twelve weeks before departure: 25% of total price
- Twelve to Six weeks before departure: 50% of total price
- Less than Six weeks before departure: 100% of total price
We recommend purchasing comprehensive travel insurance to cover cancellation costs.
5. Changes and Cancellations by Us
- We reserve the right to make changes to or cancel your booking where necessary due to circumstances beyond our control (e.g., force majeure, insufficient bookings, or safety concerns).
- If we cancel your tour, you will be offered a full refund or the option to transfer to an alternative tour of equal or greater value (subject to availability).
- If we make significant changes to your tour, you will be notified as soon as possible and given the choice to accept the changes, transfer to another tour, or receive a full refund.
6. Your Responsibilities
- You must comply with all health, safety, and security regulations and instructions provided by us or our suppliers.
- You are responsible for ensuring you have all necessary travel documents, visas, and vaccinations for your trip.
- If your behaviour is deemed inappropriate or disruptive, we reserve the right to terminate your participation in the tour without refund.
7. Our Liability
- We accept responsibility for the proper performance of our obligations under these Terms, except for any failures that are attributable to:
- Your own actions or omissions;
- Actions of a third party unconnected with the provision of the services;
- Unforeseeable or unavoidable events beyond our control.
Our liability, except for death or personal injury caused by our negligence, shall be limited to a maximum of the value paid for the tour.
8. Complaints and Disputes
- If you have a complaint, please notify your tour leader or our local representative as soon as possible so we can attempt to resolve the issue promptly.
- If your complaint is not resolved locally, please contact us in writing within 28 days of your return.
- These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
9. Data Protection
We are committed to protecting your privacy. Your personal information will be processed in accordance with the Data Protection Act 2018 and our Privacy Policy, which is available on our website.
10. General Provisions
- We reserve the right to amend these Terms at any time. The latest version will be available on our website.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
